Notwithstanding the foregoing, HMMBS may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information. You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not in a class, consolidated, or representative action.

13. Termination
